Terms of Service
These Terms of Service govern your use of dvaps.com and any services provided by Delaware Valley Aerial Photography Services ("DVAPS," "we," "us," or "our"). By engaging our services or using our website, you agree to these terms.
Services Provided
DVAPS provides commercial unmanned aerial vehicle (UAV/drone) services including but not limited to aerial photography, aerial videography, infrastructure inspection documentation, and emergency/disaster aerial support. All services are performed by an FAA Part 107 certified Remote Pilot in Command.
Specific deliverables, timelines, and pricing will be confirmed in writing prior to each engagement. A written quote or service agreement supersedes any general terms regarding scope, price, and deliverables.
Booking and Payment
To book services with DVAPS:
- Submit a service request via our website or by contacting us directly
- Review and approve the written quote and project scope
- A deposit may be required for larger projects; terms will be specified in your quote
- Full payment is due upon delivery of final files unless otherwise agreed in writing
- Invoices unpaid after 30 days are subject to a 1.5% monthly late fee
Cancellation and Rescheduling
We understand that plans change. Our cancellation policy:
- 72+ hours notice: Full refund of any deposit, no cancellation fee
- 24–72 hours notice: 50% of the quoted service fee may be retained to cover preparation and scheduling costs
- Less than 24 hours notice: Full service fee may be retained
- Weather cancellations: Flights cancelled by DVAPS due to unsafe weather or airspace conditions are rescheduled at no cost to you

Weather and Flight Conditions
Safe drone operations require acceptable weather conditions. DVAPS reserves the right to cancel, postpone, or terminate any flight at any time if conditions are deemed unsafe by the Remote Pilot in Command. This includes but is not limited to high winds, precipitation, low visibility, lightning, and airspace restrictions.
Weather decisions are final and made solely in the interest of safety. No penalty or additional fee will be charged for weather-related rescheduling initiated by DVAPS.
Client Responsibilities
When engaging DVAPS services, you agree to:
- Provide accurate information about the project location and requirements
- Obtain any necessary property owner permissions for flights over private property
- Notify DVAPS of any known hazards at or near the flight location (power lines, antennas, restricted areas)
- Ensure the flight area is clear of unauthorized personnel during operations
- Not interfere with drone operations once a flight is in progress
- Use delivered imagery and video only in accordance with the license granted below
Deliverables and Licensing
Upon receipt of full payment, DVAPS grants you a non-exclusive license to use delivered imagery and video for the purposes agreed upon in your service agreement. Standard real estate photography licenses include use in MLS listings, marketing materials, and property-related advertising.
- DVAPS retains the copyright to all imagery and video unless a full rights transfer is negotiated in writing
- Resale or sublicensing of imagery to third parties requires written consent
- DVAPS may use imagery for portfolio, marketing, and promotional purposes unless you request otherwise in writing prior to the engagement
Limitation of Liability
To the fullest extent permitted by law, DVAPS's total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim. DVAPS is not liable for indirect, consequential, incidental, or punitive damages.
DVAPS carries commercial drone liability insurance. Certificates of insurance are available upon request.
FAA Compliance
All drone operations are conducted in compliance with FAA regulations under 14 CFR Part 107. DVAPS will not perform flights that violate federal airspace regulations. Clients may not request or instruct DVAPS to perform non-compliant operations. See our FAA Compliance page for more information.
Dispute Resolution
Any dispute arising from these terms or our services will first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in Bucks County, Pennsylvania, in accordance with the rules of the American Arbitration Association. These terms are governed by the laws of the Commonwealth of Pennsylvania.
Changes to These Terms
We may update these Terms of Service from time to time. Updated terms will be posted on this page with a revised date. Your continued use of our services after any update constitutes acceptance of the revised terms.
